The social security system provides benefits if you are disabled, among other benefits. If you cannot work because of a physical or mental condition that is expected to last at least one year or result in death, you may be eligible for social security benefits.
You also may be eligible for disability payments through the Supplemental Security Income (SSI) program, if you have little income and few resources, and these benefits cover not only persons with disabilities, but children as well.
You should file for disability benefits as soon as you become disabled, because the process usually takes several months for an initial decision.
You have the right to question a decision made on your claim by filing an appeal within 60 days from the day you receive the letter telling you about the decision.
The first appeal is by way of a request for Reconsideration. If you disagree with your Reconsideration decision, you may ask for a hearing by an administrative law judge.
In addition, you may ask for two levels of further review by the Social Securities Appeals Council, and a Federal District Court.
It is important that the evidence be ready for the hearing by effectively analyzing and presenting medical documents, reports and other evidence.
My experience is that many cases are denied at the first two levels, until the hearing before the administrative law judge.
